RFE on STEM Extension

Hello,

I have received an RFE of my STEM OPT Application. The RFE reads that I need to prove that I was not unemployed for more than 90 days.

My OPT started on March 8th 2012.

1) Till April 29th I was with a consulting company that hired me as a Programmer Analyst. I was undergoing training and did not work on any project. [i have an employment letter saying that I started on March 12th 2012] I did not receive any pay.

2) From 30th April to Sept 9th I was on a full time job [i have appointment letter and paystubs]

3) From Sept 10th till now I am working for a EVERIFIED company. [i have appointment letter and paystubs]

Now my problem is for the first employer I just have an appointment letter. They are not willing to give me any other letter stating that I was undergoing training etc. That makes for 53 days. Even if USCIS does not consider this as employment I still do not cross the 90 days of unemployment. Is there a reason that I will be denied.

I am in a similar situation. I have received an for my opt stem extension.

The RFE states that i need to provide proof of employment in my first opt period.

My opt started on Jan 11th 2012 .I have joined in a consultancy 'X' on Jan 25th and got trained over there.I have submitted my employer details with start date of my employment as April 1 2012 to my college as to not execeed more than 90 days of unemployment in the opt period. I did internal project from April 15th to may 15th and i have pay stubs for that period.Later on I moved to other E-verified consultancy 'Y' where i started doing my job form July 9th.

1.) Now the problem is i don't have pay stubs for the period April 1st to April 15th and May 16th to July 8th for the time period I was in contrac with my first employer 'X'.

2.) Also what should be my reply to RFE for the period Jan 11th to April 1st?

3.) I just have a offer letter from employer 'X' stating that i'd worked with him from April 1st, 2012, will that be sufficient to reply to RFE.

Hi,

I am not sure why you waited till April 1st to get an employment letter from Consultancy 'X'. My OPT started on March 8th and I joined a counsultancy on March 12th. I took the employemnt letter from the employer and sent it to my school. I was not getting paid between March 12th to April 30th.

Every RFE is different so please read your RFE and try to provide as much information as possible. You should do your best be truthful and provide all the correct information.

1) It seems you stayed with Consultancy X from April 1st till July 9th (on record) and your OPT started on Jan 11th.I believe you are allowed 10 days gap between jobs. Since you stayed long with consultancy X for a long time try to get a letter from them with Start Date , End Date, Nature of job : Since you were undergoing internal training ask them to write that. If you did any certifications in that period attach them. Attach the pay stub that you have for your project.

2) For the second counsultancy Y attach the first pay stub and the most recent last two pay stubs.

You may also write a paragraph about your work and if yu believe you have not exceed 90 days then write that.
