Often they do not withhold enough. You may owe. Claiming dependents - especially ones who do not reside in the US - is complicated. See a tax professional - a CPA or enrolled agent - to be sure they are filed correctly. Do not make claims that you are not entitled to make in order to try to get a refund.

dont I comply as the third one. ?

Tax Exemptions Provided by Treaties

In addition to the tables in the back of this publication, this publication contains discussions of the exemptions from tax and certain other effects of the tax treaties on the following types of income.

  • Pay for certain personal services performed in the United States.

  • Pay of a professor, teacher, or researcher who teaches or performs research in the United States for a limited time.

  • Amounts received for maintenance and studies by a foreign student or apprentice who is here for study or experience.

  • Wages, salaries, and pensions paid by a foreign government.

The services of a CPA or ENROLLED AGENT are cheap compared to messing up your federal taxes.

Your issue is that you appear to want to claim your wife. Claiming a non-resident is complicated.

You seem to have a serious misunderstanding about how much you do NOT have to pay since you have been a student.
