immigration_user Posted February 22, 2013 Report Share Posted February 22, 2013 I'm LPR and have applied follow to join for my wife. Her PD is July 2007 (EB2-India). Our case is complete at NVC and waiting for dates to become current. My question is if my dates become current in the last quarter of 2013 and NVC schedules an interview, but if my PD retrogresses and no longer current on the day of the interview (or visas are exhausted for the fiscal year), will she still get the immigrant visa approved or we need to wait for our dates to become current again. Since the cutoff dates for India might only move in last quarter and very very likely it will retrogress again first quarter of next fiscal year, this keeps me worried(as my wife cant enter US without an immigrant visa). Would really appreciate if you could clarify. Thanks in advance. Link to comment
Attorney_11 Posted February 25, 2013 Report Share Posted February 25, 2013 A visa number must be immediately available for a immigrant visa to be issued. If it has retrogressed, then the interview may take place, but the visa will not be issued. Link to comment

And not when the interview actually happens? I thought this is the way it works with Consular processing cases. Link to comment
