H1B Visa Transfer after 6 Years

Hello

Got my h1 petition approved in 2006 october and visited USA in 2007 and went back abroad in 2008. Now am in US on different visa, can I apply new H1B petition with old quota???

In many situations, it may be possible to change status to H-1B without applicability of the quota if there was a previous H-1B and remainder time out of the six years is available. It is a case by case determination. A consultation with a qualified immigration attorney may be helpful.
