I am thinking of switching jobs and my new employer promised me to start the GC process 6 months after I start. My questions are: 1) Do I need the origianl approved I-140 from my current employer to get a 3 year H1B visa approval with the new employer. I have a copy of approved I140. 2) Do i need original I-140 for any other reasons like starting the GC process with my new employer? 3) Am I at a risk to lose the priority date if my current employer withdraws the I-140? Please reply
tusharvk Posted February 22, 2013 Report Posted February 22, 2013 with approved 140, it should be ok. very unlikely you will get original from your employer. on immigrationportal there was a faq that replied that uscis has sometimes taken the position that the revokation of approved 140 may result in a loss of pd.
