L1 to H1

hi ,

i am currently in L1 Visa and completing 5 years(4years 9months ) in June 2013 and company asked me to go back to india to work from india.

now i am planing to file H1 outside my company and if its approved

1)how many years i can get H1 visa

2) since i am currently in USA, am i eligible to work on H1 ( for ex: june)if my H1 got approved ? do i need to wait till Oct ?

3) if not what is the best option to cover my gap between june to oct without going back to india?

=> You will get 1 yr 3 months on H1b. L1 + H1b = 6 years

=> Because this will be your first H1b, you need to wait till Oct 1st.

=> If you are planning to leave your work in June, you would need to leave the USA before start working on Oct 1st.

Wrong. The time in L1 and H1 COMBINED can not be more than 6 years. Since the OP already had quite a lot of time on L1, he would just get the remained to 6 years.
