I'm currently holding L1B visa from Company A which is valid till April 2013 and I have I-94 upto 2016. I have applied for H1b Visa from Company B in last year's quota and it got approved in Dec 2012. From Nov 2012 till Jan 2013 I was in India when my H1b Visa got approved so when I entered USA in Jan 2013 I had H1b (approved) without stamped and L1B stamped visa and I entered through My L1b Visa. As I was in India for the month of Dec and Jan I got my pay stub in Indian currency however rest of my pay stub is in USD. Now here is my query. 1. My Company A says, as my i-94 is valid till 2016 they wont be able to extend my existing visa because they cant extend it untill I-94 expires as I-94 overrisde Visa. Is that true? Can I work in US if my visa is going to expire but I have valid I-94? 2. Can I do my H1b Transfer to Company C without joining Company B? If yes, does it needs any amendment in it if I find new job after April as from April new year's quota will start? 3. As my Pay stub of last 2 month is in Indian currency will there be a prob in doing H1b transfer to Company C? Thank for reading this and have a nice day. -- J Link to comment
t75 Posted February 21, 2013 Report Share Posted February 21, 2013 Visa is for entry; I-94 is for authorized stay. You are legal to work until the last day of your I-94. If you leave US after date on your visa, you need new stamping for entry. You cannot "transfer" because that requires you be in H1B status and not just have an approved petition. Your prospective employer would file a new petition not under cap with COS; you can go to work for them when you receive an approval and new I-94 whether via COS or by visa stamping and entry, You need to read the USCIS website for your rights and responsibilities as a guest worker in the US.
