samkru Posted February 17, 2013 Report Share Posted February 17, 2013 Hi, Company A sponsored me L1B visa and I am in US on the following dates JUN - 2007 to Aug - 2007 (6 months in India) Feb - 2008 to May - 2008 (13 months in India) Jun - 2009 to Mar - 2012 (now 11 months in India) After I came back to India got my same Company A L1B extention stamped in my passport and have it valid till FEB - 2014. I also got H1B petition approved which is filed by Company B. I want to travel to US in april with my L1B and later COS to Company B H1b. My Question is will my clock reset as I am in India for 1 year or it will not reset as I am using same old L1B which I already used for 3 years? ThanQ for ur Response Link to comment

I had lots of misunderstanding of this clock reset as this term is heavily used with big Indian s/w companies and my uncle explained me in detail if there were any such clock reset thing, no one would ideally need a green card, just maintain H1 or L1, go to India for more than 1 year and reset the clock. But that's not how it works. Clock reset is the term used for the situation wherein you stay in India for more than 1 year and then if you have a "new" petition (H1 or L1), you get full term (6 years). Link to comment

Attorney_25 Posted February 18, 2013 Report Share Posted February 18, 2013 Generally, to start a new 6-year period requires a new cap-subject H-1B petition. If a person instead re-enters and works using prior-approved L-1 and H-1B, he will only be allowed to finish out his first 6 years.
