CaptainNemo Posted February 17, 2013 Report Posted February 17, 2013 Hi , I have a valid H1B Visa (I have travelled to US and now back in India ) and am looking for H1B transfer to new company from India . In the list of documents required I see that I need copies of Latest I -94 card (front and back). However I have returned the I -94 while leaving the US last time and didn't keep a copy of the I-94 card . I have all the other documents (pay stubs , W2 s , approval notices) do I necessarily need I -94 card copy if I am applying transfer from India . Kindly advise/ help . Highly appreciate your help !

An individual seeking approval to work for an employer while outside the United States will either utilize proof of the approved petition to return to apply for a new visa at a US Consulate or Embassy abroad, or will return based on the approved H-1B visa with the prior employer and show the approval of the petition with the new employer to receive a new I-94 card denoting valid status to work for the new employer. An I-94 card is not a mandatory when the petition is filed while the beneficiary is outside the United States.
