PERM ad for new hires

Hi All,

I'm working for Higher Ed( of Nevada) in NEVADA since 6 months. My employer want to file GREEN card for me under EB2. I heard that, with in 1 year of initial hire, PERM Ad is not required to start the green card process. Is it true ?

There is(?), or at least used to be, a "reduction in recruitment" (or RIR) process whereby the original recruiting effort that was used to select the foreign worker could be used to fulfill the PERM labor certification application recruitment requirement (but I believe it was when the PERM was filed within 6 months of the employment start date). An individual would have to check with their employer's immigration attorney to find out if this option is (i) still valid with the Department of Labor (DoL), and (ii) applicable in the case in question.
