I heard that, with in 1 year of initial hire, PERM Ad is not required to start the green card process. Is it true ? Thanks in advance!! Thanks, Hari.
catx Posted February 15, 2013 Report Posted February 15, 2013 There is(?), or at least used to be, a "reduction in recruitment" (or RIR) process whereby the original recruiting effort that was used to select the foreign worker could be used to fulfill the PERM labor certification application recruitment requirement (but I believe it was when the PERM was filed within 6 months of the employment start date). An individual would have to check with their employer's immigration attorney to find out if this option is (i) still valid with the Department of Labor (DoL), and (ii) applicable in the case in question.

Please consult with a qualified immigration attorney to discuss whether you would qualify under that provision and for more information about how it works.
