WIZKID2339 Posted February 13, 2013 Report Posted February 13, 2013 Hi team, I am currently working for a client and working from the client location for the last five months. Now they are planning to move the location of our office. This will not change my roles or responsibilities. In fact we are just moving to a new building just streets away from the current one. This is because the lease on our current building is expiring. In this case do I need to amend both my LCA and H1B or just LCA? Please advise. Thanks
venky144 Posted February 13, 2013 Report Posted February 13, 2013 lca amendment is compulsory.....not sure abt h1b
wiweq Posted February 13, 2013 Report Posted February 13, 2013 "In fact we are just moving to a new building just streets away from the current one." => Think in this way: If USICS officials put the old address in their GPS, can they drive your current location? If yes, no need of LCA updates. If no, your employer needs to update the LCA. If they don't find you on your LCA location, they won't bother to find you in building just streets away.
WIZKID2339 Posted February 13, 2013 Author Report Posted February 13, 2013 Please I need some advise on this.
WIZKID2339 Posted February 14, 2013 Author Report Posted February 14, 2013 Thanks for your reply. wiweq..I understand that. My question is should I change both LCA and H1B or 'just LCA?
wiweq Posted February 14, 2013 Report Posted February 14, 2013 "My question is should I change both LCA and H1B or 'just LCA? " => There is no circular from USCIS about this, but many attorneys suggest doing H1b amendment too.
metroguy Posted February 14, 2013 Report Posted February 14, 2013 I think that should not be a problem. We used to work on multiple buildings at client site
itsmeusa Posted February 14, 2013 Report Posted February 14, 2013 Hello. Due to the fact that there is no change in your client, roles / responsibilites and that the client is moving only few blocks, I don't think you need to worry about LCA or H-1B amendment also. Regarding LCA - When an employee changes worksites, the LCA remains valid when the beneficiary is working within reasonable commuting distance (35 miles) or within the same Metropolitan Service Area (MSA) as the original worksite for which the LCA was filed. Just make sure that both these locations are in the same MSA. Once you are comfortable, you could ask your lawyer to get it confirmed.
WIZKID2339 Posted February 15, 2013 Author Report Posted February 15, 2013 Thanks everyone. Actually the distance between my current location and new location is just 5.2 miles. But the zip code is changing. I am also planning to visit India for a vacation. So a bit concerned about stamping.
venky144 Posted February 15, 2013 Report Posted February 15, 2013 i would definitely recommend file a new or ammend the current LCA....
wiweq Posted February 15, 2013 Report Posted February 15, 2013 Now, USICS expects H1b amendments for every LCA update.
