johndoe123 Posted February 12, 2013 Report Posted February 12, 2013 My employer was told by the office handling LCs today that we should not have used a hispanic paper to post our add. I believe, they used this option among the 10 along with adv in jobsites, employer website and an ethnic paper. The job title is for a programmer. All advertisements have been completed and the recruitment is currently in the cooling off period. Is this concern real? Can a job adv in a hispanic newspaper (ethnic newspaper) for a software developer be a reason for audit or denial? or is the office over reacting. The recruitment process including the mandatory procedures have been completed but at the last minute my employer was cautioned to choose another alternative for the ethnic news paper. Any view? Thoughts? FYI: They (office handling the PERM) believe there has been atlest one audit/denial since an adv in a hispanic paper was placed when a foreign language was not a requirement. Should my employer go ahead or re-advertise.? Thank You for your time.
JoeF Posted February 13, 2013 Report Posted February 13, 2013 The issue that for a job offer, ethnicity can not be a consideration. Therefore, it doesn't make any sense to post a job-offer in a publication that is targeted towards a particular ethnicity. Does the company have a lawyer? If not, they should get one ASAP.
t75 Posted February 15, 2013 Report Posted February 15, 2013 Advertisements should not be placed in media not likely to be read by legitimate job applicants.
