snowbell
Has anyone ever encountered any problem at the port of entry on their tourist while their I-130 was pending ? My Uncle who is a US citizen is planning to file for a GC for my mother (his sister). She has a tourist visa for next 8 years. Could she have trouble coming and visiting us on the tourist visa while her I-130 is in process since it will be almost 11 years from now when her visa numbers become available. I have heard that she could be denied entry at the POE because of her petition. Unfortunately, I cannot sponsor her since I am not a citizen. Link to comment
Attorney_11
Although there is no prohibition from travelling to the United States as a tourist while a preference family based petition is pending, there are risks which should be considered on a case by case basis. A consultation with an immigration attorney may help to set up a personalized strategy for long term travel. Link to comment
