h1coe Posted February 10, 2013 Report Posted February 10, 2013 Hello, I have a bit of situation here... I am currently working for Company A under H1B visa. I've recently accepted an offer from Company B and they are now in the process of transferring the visa. The receipt for application of I-129 (and I-539 for my wife) should arrive in a few days. And the transfer is done through premium processing, so it should take another 10-15 days for it to get done. Now there is another Company C from which I should be receiving an offer in about one week. And this is the company I want to work for. Now I understand that there is no restriction on applying for multiple transfers at the same time. Two situations here 1. When Company C is ready to file for my H1B transfer, they would be asking me for all the previous I-797's. is it possible to not provide I-797 of company B since i have not joined them and visa is still under process? 2. Am I suppose to inform company C about my offer from Company B? here I have just accepted offer but i have not started to work for company B hence I do not have any pay slip with them. Thanks a lot for your help.
Attorney_11 Posted February 11, 2013 Report Posted February 11, 2013 Generally, an individual must be prepared to provide proof of uninterrupted status when applying for a change of employer. Individual situations may permit a combination of documents. It may be helpful to discuss the individual matter in detail with an immigration attorney.
