Can I now apply for a new H1B visa when the quote opens in April 2013 (assuming that I would enter the country only after June 2013)? If I wait till June 2013 to apply for a new H1, the chances are that the quota might be full and I would have to wait till the next year :( Link to comment
JoeF Posted February 8, 2013 Report Share Posted February 8, 2013 An employer can only file a new H1 when you have been out of the US for one year. So, the earliest an H1 can be filed for you is June. Link to comment
