Dear Madam/Sir,

I would like to get your opinion on the following matter.

I have been presented an employment offer with a company who wants me to get into a binding agreement with them to work for a period of 18 months and if I breach the contract in the middle then I will have to pay a fixed amount every month until the end of contract. They also have a non confidentiality agreement in addition to this.

Is this fair? and what happens if I get another better opportunity with somebody else during this period. Why should I pay for the remaining period besides giving a prior notice of 2 weeks.

Is there any other alternative to this that I can suggest to him so that everybody wins?

My major concern is that I will be needing a H-1 visa in this April and my employer has not mentioned anything in the agreement that they will file for my H-1. He is insisting that my H-1 will be filed depending on my performance and I am worried that if for some reason something goes bad then they will not file for H-1 and I will be left hanging in the middle.

My current status is on OPT extension.

Please advise.

you better not take that offer ..

If you do not like the terms of the contract, look elsewhere. Otherwise, expect to abide by the terms. To determine if they are appropriate in you state, have the contract read by an attorney. (And it is likely non-compete not confidentiality)

The employer is taking a chance on you. You have an obligation to be honest and ethical in your treatment of him.
