Hi,

Company 'A' is holding my H1 visa and I have my own company 'C'. Can I make my Company 'C' as a middle vendor for my project being an employee of company 'A'.

Is this legally possible? Would there be any issues if I do it this way.

Little bit confused dude, if A is holding your H1 then who is 'C.? Who is your current vendor??

Who is running your company? If you do, then you are working illegally.

On H1, you can not run your own company. And you can not order the company management (which can't be you) to take on certain projects.

OP owns company 'C'...but his H1 employer is company 'A'

Im not sure about this...but I know for sure that you cannot make money out of company 'C'

and if you arent making money than why you want to keep company 'C' in the loop? during H1 stamping it would complicate things further.

But he is not supposed to work for 'C' on H1. That's completely illegal.

Though Company 'C' is mine, I made a greencard holder as a CEO and I made my self as an investor.

This way I can own the company legally and work for Company A who is holding my Visa.

Now the situation is, for a project, Can I make my Company 'C' as a middle vendor being an employee of Company 'A'.

I will not be working for Company 'C'. I am an employee of 'A' and they hold my H1.

If I own a Company, Profit is my earning. right?

Advantage I have being a middle vendor is, I can make my employer ('A') run mypaycheck for smaller amount and rest I can show as profits in My company ('C'), I save a lot in taxes.

No, you can't, because telling the CEO of C to do that would mean that you are actively involved in C, which is not allowed on H1.

The CEO runs the business, not you.

You have to stay completely out of that.

It seems to me that you haven't understood the concept of passive investor. You still seem to be involved in business decisions, which is NOT allowed on H1.

Wow wow hold it back. You cannot earn profits from a different company.

If he is a passive investor, he can.

For example, a person can hold Microsoft stock. That makes the person a MS co-owner. Such person can of course receive dividends from MS. As a passive investor, that's perfectly fine.

But here, it looks as if the OP is actively involved in the business. That's not allowed.
