greatguy1978 Posted February 5, 2013 Report Posted February 5, 2013 My Perm was filed with Employer A and got approved. I joined Employer B later and completing my 6 years on H1 soon. I have following questions - Can I file I-140 with Employer A, even if I am working with new employer Employer B and not working with Employer A now ? - Should I join Employer A again and then filing I-140 with Employer A will be recommended ? I have to make decision fast and would appreciate your help on the same please.
Attorney_11 Posted February 12, 2013 Report Posted February 12, 2013 An employer is permitted to file an I-140 on behalf of an individual for which it received a certified PERM even if the individual is not currently employed by the employer, provided the employer has the intent to employ the individual in the future on a permanent basis. It is advisable to speak with an immigration attorney to determine a personalized immigration strategy.
