Bleacherseat Posted February 4, 2013 Report Share Posted February 4, 2013 I would like to hear if anyone has any personal experience or knowledge of this: Are employment based immigration related expenses (which an employee can legally pay) are tax deductible? If you spend money to maintain your employment or work such as a home office etc. that is usually tax deductible. I wanted to see if immigration expenses are too. Thanks Link to comment

finn Posted February 5, 2013 Report Share Posted February 5, 2013 You can't deduct USCIS and other immigration fees in your personal taxes. However, a business that pays the fees can deduct them as a business expense. For example if your employer pays the fees, he can deduct them. Likewise, if you have your own business and the business (which may be you, if you file Schedule C) pays the fee, then you should be able to deduct the fees as a necessary business expense.
