RaghavendraKumar_s Posted February 3, 2013 Report Posted February 3, 2013 All, I have been working in a project from last two years with employer A. The same project went to Employer B. And I got offer from B for the same position and I accepted it. Right now what is the process of H1 Transfer. First Employer B told me that they are going to apply the H1 Transfer. Later they told me that they requested LCA transfer from employer A. What is the difference between H1 Transfer and LCA transfer. Did this LCA transfer is mandatory in this case. Please clarify me. Thanks
Attorney_11 Posted February 8, 2013 Report Posted February 8, 2013 Generally, H-1B petitions and LCA applications are employer, location and job opportunity specific. It is not likely, absent a corporate change, for an LCA filed by one employer to be applicable to that of an other employer or an H-1B petition for employment with one employer to be applicable to employment with another employer. A consultation with a qualified immigration attorney would clarify matters.
