dookud8 Posted January 28, 2013 Report Posted January 28, 2013 Hi All, I had H1B visa from X company ; start date Oct 2008 to 2011. I used only 5 months out of it. Now i am on L1B Visa from Y company and working in US from 2011 to till date. How can i check if my H1B petition from my X company is revoked or not ? i don't have any ways to contact my X company due to various reasons.
JoeF Posted January 29, 2013 Report Posted January 29, 2013 1. It doesn't matter. 2. An employer is required by law to inform USCIS if the H1 beneficiary no longer works for the employer, so you can safely assume that the H1 is revoked.
dookud8 Posted January 29, 2013 Author Report Posted January 29, 2013 thanks for the reply. So can i use the revoked H1B petition from my previous employer and file a fresh one from another employer ? will i come under CAP count then ?
JoeF Posted January 29, 2013 Report Posted January 29, 2013 If you have been counted for the quota in the last 6 years, you are not counted again. It is irrelevant if a previous petition was revoked or not.
