I am planning to transfer due to employer issues. can some one tell me how many years of visa will i get if i transfer now based on my 140 approval. Some one please answer sri........ Link to comment
metroguy Posted January 28, 2013 Report Share Posted January 28, 2013 My friend got it for 3 years. In your H1B ur attorney will mention that you have I140 approved and its petition number by mentioning that you have an immigration petion filed. So you will be getting 3 years. Link to comment

Depending on your new job, you can get up to 3 years (you may get less if you are consulting or have layers or if your unlucky). I know of friends who changed employer in 5th year H1B with an approved I-140 and got three years during transfer (this was about a year ago, so I don't know if rules have changed now). You would have to start your GC process again (PERM, I140..) with the new employer, though. Link to comment

So the more still i delay , the less period of h1 i get correct ? that means if i transfer in the last stage of 6th yr , i think no one will even able to transfer my H1 correct ? Thankyou sri...
