jitu1031
Hi, Currently I am working in INDIA for company A and I have an offer from USA company B. Company B has stared (June 2011) my H1B process, Now Company A is also wanted to send me on L1 and they wanted to start L1 process during Sep 2011. I have some doubts - 1. Can I go for L1 even I have H1B stamped for company B? is it against law? 2. If i apply L1 after approved H1, H1 will be cancelled? 3. My wife also wanted to work in USA, which dependent visa (H4 or L2) will good for her to start work as soon as possible? Thanks Link to comment
Transformer
1. Can I go for L1 even I have H1B stamped for company B? is it against law? ---Yes. It's not against law. 2. If i apply L1 after approved H1, H1 will be cancelled? ---No, unless your employer revokes H1B.But you can always be only on one status in USA. So if you want to switch from L1 to H1 in the future (while in USA), you need to file COS or go out of country and reenter with H1. 3. My wife also wanted to work in USA, which dependent visa (H4 or L2) will good for her to start work as soon as possible? ---H4 can't work, period. If you want your wife to work then you need to be on L1, so that she can work on L2. Link to comment
