diya1 Posted January 25, 2013 Report Posted January 25, 2013 Hi, I just moved to H1B from L1B visa last year and i started working on H1B from November 2012.Till November i was working on L1B visa.I am a contractor with 1 company and i do have a vendor between my employer and client. I am planning to visit India in Feb which means i have to get my visa stamped for coming back to US. Please suggest how safe it is to go to India for stamping right now or can i go to Canada. Since it would be first H1B stamping for me so i heard it might be difficult if i go to Canada please tell me how true it is. Thanks.

While people do get stamping done in Canada, they advise third country nationals to go to their home country for the first stamping in a category (in this case, H-1B). Visa stamping is never going to be a cakewalk - especially if you're a contractor - but with all documents from you, your employer, your vendor and your client (need all their co-operation), you would have done your best. The rest is up to God - in this case the visa officer who talks to you. Frankly, cases and results vary widely depending on who interviews you and what he feels about your case. Browse this forum and other resources online to find lists of all documents needed as a contractor, and work with all the above parties to get them in order, before you plan your trip. Even when armed with all documents, the VO may put you on 221g - administrative processing - and may need to contact your company to verify the position, project and such. So be prepared for an extended stay, but hope for the best.
hangover Posted January 28, 2013 Report Posted January 28, 2013 I guess you cannot go to Canada if you do not have master's from USA universities. I am not sure about it.
