SriniGC Posted January 23, 2013 Report Posted January 23, 2013 I ported my old priorty date (Sep 2005) to EB2 case in July 2012. I am from India. My 485 was filed on Aug 2007. 140 was approved on July 2012 and it has Sep 2005 priorty date. Since dates has retrogressed, I am eagerly waiting for my GC. Meanwhile the market is too good and I would like to pursue those opportunities. I would like to work for NEW employer and not My present employer who filed my GC in Eb2. I have already used AC21 once, when I joined my EB2 sponsoring employer Can I use AC 21 again and join new employer ..? Would that impact my GC process....? Can cancellation of 140 trigger RFE on my 485 application ..? Has anyone tried this ...? Please share your inputs.

Would it affect my green card process, if I use AC21 and change my employer before 485 approval...? I am planning to leave my present employer who file GC in Eb2 category and ported my Eb3 date.
shandan Posted January 28, 2013 Report Posted January 28, 2013 There should not be any negative effect of using AC21 as it is meant for the very same purpose as you wish to use it for. There might be RFE regarding the new employer's EVL and pay stubs for the I-485. To verify the employment.
Belle Posted January 28, 2013 Report Posted January 28, 2013 Your EB2 I-140 is portable under AC21. AC21 is AC21 - by its nature, it is of itself an impact on your I-485.
