goutham31 Posted January 20, 2013 Report Posted January 20, 2013 Hi Gurus, I have a 29-month STEM OPT and my 17-month extension OPT expires by March, 2014. So, I assume that I should be filing for H1B Visa by April 1, 2013 since my OPT expires by March itself in 2014. Or is there any way in which I can file for H1B Visa in 2014? Please advise.
pontevecchio Posted January 21, 2013 Report Posted January 21, 2013 Please research Cap gap. Also an employer files your H1 petition. The h1 visa is a stamp in your passport.
catx Posted January 21, 2013 Report Posted January 21, 2013 An H-1B visa petition needs to be filed for you by a sponsoring employer between April 1, 2013 and the date the quota is filled for a visa starting on October 1, 2013. If not, your F-1 visa and OPT employment authorization will expire before the next H-1B visa petition period in 2014.

So, my employer should be filing for my H1B, anytime from April1, 2013 and before the quota gets filled for 2013. Is that correct?
