mohan_krish81 Posted January 17, 2013 Report Posted January 17, 2013 Hi, My wife has Valid H4 visa till 27 Sep 2013. Last time when she entered US she got I94 date only till 27 Sep 2011, however my daughter who came along with her got I94 till 27 Sep 2013.We did not notice the I94 expiration date, just now we noticed it. Will this be a clerical error and can be changed at CBP office? If not clerical error, what are my options? Thanks, Krish
mohan_krish81 Posted January 17, 2013 Author Report Posted January 17, 2013 Few more information to make it very clear. She has valid Passport till 2018 and she entered US on 27 July 2011. Any help is appreciated
JoeF Posted January 17, 2013 Report Posted January 17, 2013 You need to see a lawyer ASAP. She has been out of status for over a year.
pontevecchio Posted January 17, 2013 Report Posted January 17, 2013 Get it corrected at the CBP Office nearest to you. If no joy get a Lawyer involved.
mohan_krish81 Posted January 17, 2013 Author Report Posted January 17, 2013 Thanks everyone. My Attorney said CBP office is not the best option since she is out of status for more than a year. We are requesting Nunc Pro Tunc for her H4 extension.
arizonian Posted January 17, 2013 Report Posted January 17, 2013 I went through similar situation but i was still in status. It's very easy to get it corrected at nearest CBP office. Take the latest I-797 along. Good luck.
pontevecchio Posted January 18, 2013 Report Posted January 18, 2013 CBP error is easily corrected by the CBP. Get a better lawyer or MAKE him talk to the CBP first.
