Megnaik Posted January 15, 2013 Report Posted January 15, 2013 Please share your experience if you have gone for stamping without H1 Amendment but with certified LCA for a change of client location. I have the client letter, would that suffice? Would really appreciate!
rahul412 Posted January 15, 2013 Report Posted January 15, 2013 Please share your experience if you have gone for stamping without H1 Amendment but with certified LCA for a change of client location. There are people who got their visa without amendment. But it all depends on your luck.
rangadu Posted January 15, 2013 Report Posted January 15, 2013 Why do you want to avoid filing amendment? USCIS folks are actively conducting site visits to client locations to confirm that employees are indeed working there. And I know of companies/employees that got into trouble because they did not file timely amendments and employees were not working at listed client location. USCIS doesn't access your LCA unless you file some kind of amendment or send a letter to them notifying them of the change of client. LCA by itself is not sufficient any longer. I know it doesn't answer your question. But dont trust your luck when it comes to filing amendments, more so when you are going for stamping.
rahul412 Posted January 16, 2013 Report Posted January 16, 2013 But dont trust your luck when it comes to filing amendments, more so when you are going for stamping. But most of the people think that my friend got visa without amendment so I will also get without amendment.
Megnaik Posted January 16, 2013 Author Report Posted January 16, 2013 I spoke to my employer, they say New LCA with client letter should suffice and there is not a clear regulation requiring an amended petition. I am in a situation where i need to go for stamping, and have scheduled an appointment on Feb 8th in Montreal. So, I was hoping to know some experiences who went to Montreal with same situation as mine and got stamping or got rejected.
