vsrcl Posted January 11, 2013 Report Posted January 11, 2013 Hi, I had completed my 6 years on H1B on 09/08/2012, so I had to leave the country on 9/3/2012. My PERM was filed on 03/23/2012 and got the approval on 11/13/2012 while in India. I am working for the same client in US business hours from India and payroll is being run in India. My employer is planning to file I-140 in premium mode for which they need my current US paystubs to prove the Ability to Pay requirement on I-140. Is it legal to run my payroll in US working from my employer's offshore development center. Any feedback/suggestion on this is greatly appreciated Thank you!
pontevecchio Posted January 12, 2013 Report Posted January 12, 2013 They do not need current stubs to show ability to pay. They need to show proof of financial solvency only if asked. What you do in India is not material? As long as you sort out the taxation issues that is fine.
