seema3982 Posted January 9, 2013 Report Posted January 9, 2013 Hi, I came to US in Aug 2009 on L1 visa. Later on I got transferred to H1 for a different company in Oct 2010. I got the H1 transferred to another company in Sept 2011 and have been working with the same company now and the same client. My Client is a direct client to Company A and Company A owns my employer company B My employer says they can provide me documentations to establish the relation between Company A and B as sister companies. Is this considered as EC model or EVC? Is it safe to go to Canada for my first H1 stamping since I have about 3.5 yrs of latest work experience in US out of the total 8 plus years of experience or should I go to India?

However, please note that wherever you attend there is a possibility that your application may require Administrative processing (221g). And in the even it is required it will take several weeks depending on your case. If your employer allows you to work remotely, I would recommend you to go to India for stamping. That way even if it gets delayed you can work from there and spend some time with family (assuming India is your home country). In my case, I came to Canada last month (Dec 17) and still waiting for my passport. All the best!
