itstud Posted January 7, 2013 Report Posted January 7, 2013 My brother got fresh H1b approval but he has a situation wherein he will have to change his employer, employer who sponsored his H1b is fine with it. Can he transfer his h1b to new employer ? considering the fac he did not work for sponsoring employer and he does not have any paystubs. He is in India and his visa is stamped already. can the new employer transfer his h1b while he is in India ?
pontevecchio Posted January 8, 2013 Report Posted January 8, 2013 Yes. It means the new employer would need to file and get a non cap H1 petition approved and he will need to get a visa and come over on approval.
