sinra Posted January 4, 2013 Report Posted January 4, 2013 My husband's H1B visa was approved recently(after 8 mnths), but he received a 221G request at stamping and is waiting for considerable time now on the employer for more docs. He has a valid H4 visa which was applied after the H1 and he has since traveled back n forth. Will it be possible to obtain an H1 transfer if he finds a job while on his H4 visa? His original I797 is still with the US consulate but his passport is with him. Are there any loopholes are workarounds for us? Please advice.
sinra Posted January 7, 2013 Author Report Posted January 7, 2013 Yes? Meaning even though he hasn't started work using the H1B visa that is approved, it can still be transferred to another employer? Isn't proof employment needed like paystubs, I-797 original petition to transfer an H1B visa ?
