H1B Transfer (Original revoked) - F1 applied

Dear Murthy Forum,

I have a Job offer from Employer 2, that requires me to start on Jan 7th 2013. Today is Dec 31, 2012.

They have not filed my LCA yet.

In 2012, I was on H1B legal Status till Dec 14th. My previous company Employer 1, (IT company) gave me letter for termination of contract suddenly in 1st week of Dec. On 7th Dec they told me that I don't work with them Since Nov 30th. (A back dated termination letter).

Now Unfortunately On Dec 14th my H1 was withdrawn (revoked) by USCIS.

I applied for F1 ASAP at my old university. So on Dec 19th, I got receipt number from USCIS for F1 Application (So I am in legal status now).

My question is:

If the Employer 2 Files for my H1 transfer then Can it be approved ?

If it is approved then would it be approved in consular processing ?

What are the chances that a revoked H1B can be transferred within 2 OR 3 weeks. ?

So, what was your status from Dec 15th to Dec 19th?

Since now that you have joined the school, it's better to go to school than applying for H1 because F1 is for student program and cannot be used to be in legal status.
