I understand I can file H1B extension for 3 years since my I-140 is approved and I will have to go through labor and I-140 process again with the new company. My question is can I change my job after Sep 2013 after receiving H1B extension? Will I be able to transfer H1B to new company?
pontevecchio Posted December 27, 2012 Report Posted December 27, 2012 You are eligible for a 3 year H1 petition extension now which would include the time till September,2013. once THE I-140 IS REVOKED IF IT IS REVOKED NO FURTHER h1 EXTENSIONS BEYOND THOSE ALREADY GRANTED. if you get a three year extension after the first 6 based on an approved I-140 and then the next day the I140 is revoked the current H1 extension stands. You have to discuss your specific case with a Lawyer.

Just so I understand this correctly, if I change jobs after my H1B extension based on approved I-140 is approved, I get 3 years of H1B regardless of whether my I-140 is revoked by employer? So that means it is safer to change jobs after Sep 2013. Is my understanding correct?
