longliveajay Posted December 19, 2012 Report Posted December 19, 2012 Folks, I read a lot of threads on "H1B - remainder" option but am still confused. Here is my situation : My first H1B was filed in 2004 Just few months after getting the approval I quit and joined another employer. by getting my H1B transferred. A year later, I yet again got the H1B transferred to a third employer. According to my last I-129 form this H1B Visa was valid from 6/22/2005 to 5/15/2008. However in July 2007, I had to quit my job and return to my country. Hence out of the 6 year period, I believe I still have 2 - 3 years of H1B pending. If I now get a job offer from a US based company, can they file under my old H1b as a "Remainder" option or do they have to file under under NEW H1B quota (in which case I will have to wait until Oct 2012 to begin employment) Pls advice ..
