mk9 Posted December 18, 2012 Report Posted December 18, 2012 Hello All, I am working with my employer who filled for my labor and I-140. Both labor and I-140 are approved. If I change my employer and transfer my H1B to another employer can I take my PD with me which is Oct 2007 EB3 or would I loose my date and would have to file a fresh labor with new labor date? Any help is greatly appreciated. Thanks MK
pontevecchio Posted December 18, 2012 Report Posted December 18, 2012 You would ordinarily retain the PD though the new employer has to start from Scratch..PERM and then I-140 .

pontevecchio Posted December 19, 2012 Report Posted December 19, 2012 You cannot file a PERM. If an employer wants to he is presumably able to have his Lawyer do the necessary. You can work with any employer with work authorization.
