H1B transfer from one employer to another with previous labor date

Hello All,

I am working with my employer who filled for my labor and I-140. Both labor and I-140 are approved.

If I change my employer and transfer my H1B to another employer can I take my PD with me which is Oct 2007 EB3 or would I loose my date and would have to file a fresh labor with new labor date?

Any help is greatly appreciated.

You would ordinarily retain the PD though the new employer has to start from Scratch..PERM and then I-140 .

You cannot file a PERM. If an employer wants to he is presumably able to have his Lawyer do the necessary. You can work with any employer with work authorization.
