indiannusa Posted December 11, 2012 Report Posted December 11, 2012 Hello Folks - One of my friends H1B is getting expired on 12/21/2012 and his company (MNC) filed for his extension but he didnt get the receipt yet. Is he legally allowed to work even though if he doesnt receive receipt number by 12/21/2012?? Can anyone please provide some information. Thanks.

cooldude76 Posted December 17, 2012 Report Posted December 17, 2012 Yes if the application is sent to USCIS before the visa expiry he can work for 240 days after H1 expiry. If he doesnt get a decision by 240 days then he needs to stop working. although he can stay in US till the decision is taken.
