tinkuR Posted December 5, 2012 Report Posted December 5, 2012 what is the permissible gap in paystubs which is allowed to go for visa stamping in Vacouver ,have heard from a lawyer that if the employer does not pay you while on bench we need to go to India for stamping please advice
JoeF Posted December 5, 2012 Report Posted December 5, 2012 On H1, you need to get paid ALL THE TIME, even on bench. That's the law, and the employer knows it. If your employer doesn't want to pay you, file a complaint with DOL on form WH4. If you don't do that, you are out of status, and won't be able to get a visa stamp.

If you don't do that, you are out of status, and won't be able to get a visa stamp. my employer asked me to take unpaid vacation and then for 2 months (so i can find a proj in the mean time ) I am planning to work for couple of months once i am an a proj and then go for visa stamping in vancouver would that be fine please advice
