shaa Posted November 30, 2012 Report Posted November 30, 2012 Hello Friends, Here is the situation. I 485 pending, working on EAD...but if I get laid off. What are my options? 1. Do I need to leave US immediately? 2. Can I look for another job with same profile as my 485 is still pending and PD not current? 3. Is there any time limit for me to find smilar job on EAD while I 485 is pending? assuming PD not current. Thank you
pontevecchio Posted November 30, 2012 Report Posted November 30, 2012 1. NO. You are legally awaiting AOS. 2. Yes..AC21 3. NO. They may or may not ask for an EVL at any time. It is also possible you get the GC with no further queries.

May be , I didnt frame my question clearly, Situation - JOB 1 working on EAD and laid off after some time... Still searching for job 2 . Now, how long do I have to search for job 1 and stay in US on EAD , after being laid off form job 1. In other words , time gao between Job 1 and job 2. Thank you.
gopalat Posted December 3, 2012 Report Posted December 3, 2012 What if the GC sponsoring employer sends a letter to USCIS saying we laid off the employee and the future job is not present. Do employers usually send any letters to USICIS after terminating the employee
pontevecchio Posted December 3, 2012 Report Posted December 3, 2012 As long as you are not officially informed that your AOS is denied you can stay for ever and a day or till the AOS is approved whichever is earliest. Please get a Lawyer onboard.
tusharvk Posted December 4, 2012 Report Posted December 4, 2012 What if the GC sponsoring employer sends a letter to USCIS saying we laid off the employee and the future job is not present. Do employers usually send any letters to USICIS after terminating the employee may be some employers send letter saying the job is longer present. The key is that the 485 is pending for 180 days and 140 is approved. If so, then, AC21 applies.
