sathishmca3 Posted November 27, 2012 Report Posted November 27, 2012 Recently I filed my H1 Extension and got RFE. I still don't know the reason as my employer is yet to receive the RFE notice. My I94 is still valid for 1 more month. Please guide me as I wanted to know the options that I would have in this case. Can new employer file a new H1 while I am in US ? Also I have consumed 3 yrs 11 months on H1.
shandan Posted November 27, 2012 Report Posted November 27, 2012 do not jump the gun, wait for the RFE to be received you will have 90 days to respond. usually the RFE is for recent pay stubs or something of that sort, so do not panic. I brother just got his extension after an RFE for most recent paystubs.

In case my h1 get denied before i 94 expires what are all the options I can do??? can any one suggest on this

cooldude76 Posted November 28, 2012 Report Posted November 28, 2012 Is your case in premium processing, if not then I don't think you can expect a decision before your I-94 expires that's 30 Dec 2012.

You need to provide the requested documents, submitting other documents will result in rejection.

Although the accuracy of internet resources is not always guaranteed the information summarised above casts significant doubt up on the legitimacy of your business and validity of employment offered. please provide additional evidence to rebut this information and evidence to support your contention that the business location listed in the petetion is a fully funtioning place of employment that can accommodate of your current employees as well as potential employees your have petetioned for.Such information may include - photographs of the business property and operations - affidavits from neighbors , other businesses , civic organizations, local government entities and - any other evidence to support your claim that this is a bonafide employer and onging business entity. Submit copy of lease or rental Agrement; the lease or rental agrement must clearly specify the date of the lease begin , subsequent renewal dates , the amount of space rented and monthly charge. submit evidance that your business has registered with in the last year with authority in the state in which you operate My employer has requested the client for lease documents and they are not ready to issue them.What are all the other documents that we can provide for this Rfe?

After reading your RFE I am 110% sure that your client won't provide those kind of documents(I am not discouraging you). You have two options 1.Find another long term project (or) 2. Give a call to Murthy firm. In fact I never heard USCIS asking those types of documents.
