2 i797 forms, Can i go for stamping ?

Hi,

I have my current H1B till March 31 2013.

I had applied for H1B amendment in June 2012. I had a RFE for client letter and i was able to present it to my amendment approved.

With my H1B amendment approved i received a new I-797A which has a validity form 04/01/2012 to 05/15/2015.

My question is if i go for stamping right now will i be stamped till Mar 2013 only or will they be able to consider the new I-797 form ?

since its validity begin date is April 1st 2013.

Hi Vijay,

I am in the same situation, my intial H1 was until Sep 30 2013, recently I had my amendment done.They approved my recent application starting Nov 03 2012 to Nov 02 2015. My Employer suggested me to carry both, but show most recent one to VO. Incase he asks any further question you can say that u applied for extension or amendment and they approved until 2015 and show your old I797 as proof for what you said.

In your above post you said time duration on your current latest I797 as validity form 04/01/2012 to 05/15/2015. but later you said the validity starts from 04/01/2013, i don't think it will be from 04/01/2013, could you please check one more time in your I797 that when it starts from.

In summary as per my employer carry both and present latest one.

My bad it was a typo. My new H1 is from 04/01/2013 - 05/14/2015. My old H1 is upto 03/31/2013.

Ur response gives me hope that i can go for stamping soon. Thanks.

I have also asked my employer to verify with our attorney and am waiting for their reply.

So did you go for stamping before ur new H1 started ?

They will stamp you till 2015.

They only considered the latest I-797
