nineballs Posted November 19, 2012 Report Posted November 19, 2012 Hi, I recently started working for a new client at a new location. My attorney filed a new LCA and got it approved. I was wondering if I need H1b amendment too? Other than client and work location, everything else is approximately same. Thanks.
JoeF Posted November 19, 2012 Report Posted November 19, 2012 Yes, both LCA and H1 need to be amended.

New client means material change in your H1 petition, I think you need Amendment too.
Attorney_23 Posted November 19, 2012 Report Posted November 19, 2012 In general, if an LCA has been filed and certified for the new employment location, the appropriate worksite posting has taken place, and other wage and hour obligations are met, an amended petition is not required simply on the basis of a geographic move.
Attorney_23 Posted November 19, 2012 Report Posted November 19, 2012 I should point out, however, that we oftentimes have our clients file an amended petition to be on the safe side. The government has cracked down on this, so filing an amended petition prior to moving to the new work sight is generally preferable.
