DUI influence on H1B Visa stamping.

Hey Flocks,

I was charged with DUI 3 years ago back in October of 2009, I was pleaded guilty, my license was suspended for 3 months, I was asked to attend DUI awareness classes which i did and my license was reinstated after 3 months, since then i have graduated from my masters and recently got my status converted to H1B from F1 successfully, now i am planning to go to Vancouver Canada for Visa interview on H1B in the month of January in 2013, I recently got my Canadian Visa to travel.

I have the following questions moving forward -:

1) So far while filling out documents for H1B or for Canadian visiting visa i did not mentioned that i was arrested for DUI and in neither of the occasions i was not queried about my DUI so i am wondering if i have to mention about my arrest or DUI situation while filling out the DS160 forms ?

2) What are the consequences if i do not mention about my arrest or DUI in DS160 forms or at the time of interview and the Visa Officer happens to pull up my DUI record ?

3) If i do not mention anything about my arrest or DUI in DS160 forms, Is there a chance that this might go unnoticed at the time of visa interview ?

4) Unfortunately i do not have any of the documents from the time of my arrest and my court appearance for DUI, Is it possible to retrieve those documents ? If so what are the documents that i would need for my visa interview and at port of entry, How and where can i retrieve them ?

5) I have been well behaved and responsible since i got my DUI, I am so careful now that since my DUI i havent had any tickets on my record at all not even the minor ones. Will this progress help me in my interview or if i am stopped at port of entry for this ? Is there any way i can prove my progress ?

6) What kind of questions can i expect from the Visa Officer or at the port of entry pertaining to my DUI ?

7) Since its been 3 years will the DUI still appear on my records ? Is there anyway i can expunge it ? Would it be useful if i am able to expunge it ?

I would extremely appreciate if some one can take their time out to answer these questions, thanks in advance and looking forward for your expertise.

A material misrepresentation could get you banned for life. I would suggest discussing the matter in full detail with say the firm of Murthy. Expungement is a good idea if your state allows it. But the records will always be available for Immigration purposes.
