I got my first H-1B from a profit company in 2009 after which I switched to another profit company in 2011. I got a job now in a non-profit company so I understand that the H-1B visa transfer will be a usual process but my concern is what if I want to switch back from the non-profit(the one that I am going to join) back to a profit company? Would the H-1B transfer process from non-profit to profit same as I have had before or will I fall under the quota and have tyo wait to file it on April 1? Are there usually any issues with H-1B or filing green card through a non-profit? Link to comment
JoeF Posted November 18, 2012 Report Share Posted November 18, 2012 If you have been counted for the quota in the last 6 years, you are not counted again and can transfer between cap-exempt and non-cap-exempt employers in either direction at any time. Link to comment
