EB1-OR-applicant Posted November 16, 2012 Report Posted November 16, 2012 I am through with the first 6 years of my H1B and I also have my I-140 approved in EB2. Although I am eligible for 3-year extension and have also applied for the same, USCIS made a mistake and sent the approval notice for 1-year period only. The company lawyer is talking to their liaison with USCIS in the "hope" of getting the approval period corrected. Is there anything I should do (like getting in touch with USCIS) to get my approval notice corrected? Also, are there any chances that USCIS would not correct such a blatant mistake? sb1234 Posted November 16, 2012 Report Posted November 16, 2012 I have no idea about your case but I have seen and heard of many cases who have got H1B approval for only 1-year. I think it depends on the officer that dealt the case only feels that the petition can be valid for 1 year or so. There is no such thing called Eligible and Applicable I believe. But since your Lawyer is already talking to USCIS, I think you can count on him and wait instead of calling and getting in touch with them.
