spangroup Posted November 10, 2012 Report Posted November 10, 2012 Hello Gurus, My wife is on H4 and will be completing her Masters coursework on May 10 2013. But she wont get her actual degree certificate until July. So my question is that Will she be eligible to file under H1B Masters quota after May 10th as she finished her course work? We dont want to wait till July as the quota may be reached. Please clarify. Thanks Kiran
t75 Posted November 11, 2012 Report Posted November 11, 2012 When will her degree be "conferred"? Is the ceremony in May or July? Have her check with the registrars office as to when they post graduation on transcript.
spangroup Posted November 20, 2012 Author Report Posted November 20, 2012 Your wife is cap exempt..so no worries about quotas. Hi Shiv, Thanks for your response but I thought H4 - H1 change of status actually falls under quota? Please clarify. Thanks
spangroup Posted November 20, 2012 Author Report Posted November 20, 2012 When will her degree be "conferred"? Is the ceremony in May or July? Have her check with the registrars office as to when they post graduation on transcript. Hi T75, I had my wife verify with the registrars office found that they confer the degress in July. So, do you think we can apply in Masters quota after course completion without waiting for her degree? Thanks
JoeF Posted November 21, 2012 Report Posted November 21, 2012 Your wife is cap exempt..so no worries about quotas. Huh? Unless she had an H1 before, she would fall under the cap.
JoeF Posted November 28, 2012 Report Posted November 28, 2012 She is finishing her Masters here..so she does not get counted in the regular h1 quota She would still be subject to the Advanced degree cap.
spangroup Posted November 30, 2012 Author Report Posted November 30, 2012 Hi JoeF, So do you think we can apply for her H1B in Masters quota right after her course completion in May (or) do we wait for the degree to be conferred in July to be eligible for Masters quota? Please clarify. Thanks
