applying4usvisa Posted November 10, 2012 Report Posted November 10, 2012 Hello, I received 221G in August (Mumbai Consulate) and I have been waiting for my employer to send em the documents asked by VO. In the mean time I found a new sponsor ready to file H1B for me. So, 1. What happens to my current employer's petition once the new employer's gets approved (hopefully)? 2. if new petition get rejected, can I submit documents from current employer using old petition? 3. If I am going with new (approved) petition I think I will have to tell my current employer to withdraw his petition, correct? 4. Will current 221G create any problems for new new H1B? What will be best answer to tackle this questions? Please suggest! Cheers,
pontevecchio Posted November 11, 2012 Report Posted November 11, 2012 1. Not your problem. 2. Yes even if there is no new petition involved. 3. Wrong. 4. It depends on the basis of the 221g.
applying4usvisa Posted December 20, 2012 Author Report Posted December 20, 2012 ** Got new application approved. ** Background: I got 221G (Blue) @ Mumbai in August 2012. A new employer filed for H1B and I got it approved while old visa application was under admin processing. I had carried a letter to request to withdraw the old visa application stating all details of old visa application (DS-160#, petition #, petitioner, beneficiary, date of interview etc.) and attached 221G, I-129, I-797 and LCA copies. Coincidence the same VO took my new interview so it was easy to break the ice for me. He just asked name, business line, role and responsibilities and salary. And approved the visa. I was freaking about my visa interview and needed to go back to US badly. I understand feeling of all people got rejected, under admin processing and waiting for results/interview. Good luck to all of them. Prepare well. Have faith.
