Siva_ebs Posted November 8, 2012 Report Posted November 8, 2012 My 485 was filed in Feb this year(PD:Oct 08), my employer didn't file EAD/AP along with my 485(as company attorney said i do need EAD/AP as my H1B is valid till 2014)..due to potential lay off issues(I am still with my employer who filed my H1b/labor/i-140/485 etc), I filed EAD myself in September(Texas service center) still did not get any approval (some of my friends who filed later got approved in a month) and i was going through the copy of my EAD application and realized that i may have made error on one of the questions.. For Q15. For current Immigration status> I wrote H1B-temp worker ( instead of Pending adjustment ???) and I have not gotten any RFE's or denial notices.. If my EAD get's denied, can i re-apply and/or any impact on my I-485 application? appreciate any thoughts/ suggestions Thanks
Belle Posted November 9, 2012 Report Posted November 9, 2012 You answered the question correctly. Actually, if you have filed based on AOS, nobody is going to look at this question anyway because it is only important if you file as L2 or J2.

I did filed (also i did not file for AP just EAD) it based on aos (EB2).. when my employer filed my(wife as derivative) aos back in Feb, they did file ead/ap for my wife and she has gotten one year validity date and they are renewing her ead/ap , on her renewal application, it says her current immigration status is "Pending adjustment" (she never user her ead and she is till on H4) and that got me worried, thinking that i made an error on my application Thanks..
