sree14 Posted November 8, 2012 Report Posted November 8, 2012 Hi All, My current company which holds my h1b is splitting into two separate companies A and B and I ll be moved to company B. At the same time, I am planning to move to a new employer totally and get my h1b visa transferred. Do I need to wait until my current employer completes the legal process involved in splitting (updating public records or ammendment to h1b if required etc.. ) before I transfer my h1? Or can I use my existing I797 and get transferred to a different employer? My next month pay stub may have the new company name (B) on it and my other pay stubs and i797 will have old company (before splitting) name (A) on them When I submit my paystubs and I797 for h1 transfer, will this company split cause an issue? If so, what additional documents will I be requiring to avoid any issues with H1b transfer? Note: I donot want my current employer to know that I am changing jobs Experts, please advise.
