My Questions here are: Can I get the Approval copy-Labor/140 from my employer (My employer doesn't give me as he says its company policy/info and we dont give) If I change my employer can I have my I 140 Transferred so that I can have my priority date. pontevecchio Posted November 4, 2012 Report Posted November 4, 2012 Try FOIA for copies. You can retain the PD if any other employer starts from PERM,I140 etc.

Do you mean that I can still retain my PD even if my employer is not willing to give me the I-140. Are we requesting help from FOIA to provide the I-140 approval notice or they should provide if we request them?

You are using the law to obtain any and all documents related to your Immigration petition and you are hoping a clerk makes a mistake and sends you the I140 approval also. Yes, it is the employers right to withhold it.
